These Terms of Service (“Terms”) are a binding agreement between you and See The World Closer (“See The World Closer,” “we,” “us,” or “our”), the operator of the website at seetheworldcloser.com and related services (the “Service”). By accessing or using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.

1. Eligibility

You must be at least 13 years old to use the Service. If you are under the age of majority in your jurisdiction, you may use the Service only with the involvement and consent of a parent or legal guardian. By using the Service, you represent and warrant that you meet these requirements and that all information you provide is accurate.

2. Your Account

You are responsible for all activity that occurs under your account and for keeping your login credentials secure. You agree to notify us immediately of any unauthorized use. We are not liable for any loss arising from unauthorized use of your account. We may suspend, disable, or terminate your account at any time, for any reason, at our sole discretion.

3. User Content

The Service lets you post photos, videos, text, comments, and other materials (“User Content”). You retain ownership of your User Content. However, by posting User Content you grant us a worldwide, non-exclusive, royalty-free, transferable, sublicensable, perpetual license to host, store, reproduce, modify, adapt, publish, translate, publicly display, publicly perform, and distribute that User Content in connection with operating, promoting, and improving the Service, in any media now known or later developed.

You represent and warrant that:

• you own or have all rights necessary to your User Content and to grant the license above;
• your User Content does not infringe or violate any third party’s intellectual property, privacy, publicity, or other rights;
• your User Content complies with these Terms and all applicable laws.

You are solely responsible for your User Content and the consequences of posting it. We do not endorse and are not responsible for any User Content.

4. Acceptable Use

You agree not to, and not to allow any third party to:

• post content that is unlawful, infringing, defamatory, obscene, pornographic, hateful, harassing, threatening, or that exploits or endangers minors;
• impersonate any person or entity or misrepresent your affiliation;
• upload viruses, malware, or any code intended to disrupt or harm;
• spam, phish, or engage in fraudulent, deceptive, or misleading activity;
• harvest, scrape, or collect data about other users without consent;
• attempt to gain unauthorized access to the Service, other accounts, or our systems;
• use the Service to violate any applicable law or regulation, or the rights of others.

5. Content Moderation and Removal

We may, but are not obligated to, monitor, review, edit, remove, or disable access to any User Content, and suspend or terminate any account, at any time and for any reason, without notice and without liability to you. We are not responsible for any failure or delay in removing User Content.

6. Intellectual Property

The Service, including its design, text, graphics, logos, and software (excluding User Content), is owned by us or our licensors and is protected by intellectual property laws. Except as expressly permitted, you may not copy, modify, distribute, sell, or lease any part of the Service.

7. Copyright & DMCA

We respect intellectual property rights and expect users to do the same. If you believe your work has been copied or used in a way that constitutes infringement, send a notice to hello@seetheworldcloser.comincluding: (a) your signature; (b) identification of the copyrighted work; (c) identification of the allegedly infringing material and its location; (d) your contact information; (e) a statement of good-faith belief that the use is not authorized; and (f) a statement, under penalty of perjury, that your notice is accurate and that you are the owner or authorized to act on the owner’s behalf. We may remove allegedly infringing content and terminate repeat infringers.

8. Third-Party Content, Links & Advertising

The Service may contain links to or embeds of third-party content, including videos from external platforms. We do not control and are not responsible for third-party content, websites, or services, and your use of them is at your own risk and subject to their terms.

The Service is supported by advertising. We may display advertisements, sponsored content, and promotional materials on the Service, including alongside or near User Content, and we may do so without compensation to you. Ads may be served by us or by third-party advertising partners. We are not responsible for the content of any third-party advertisement or for products or services offered through it, and any dealings you have with advertisers are solely between you and the advertiser. You agree not to interfere with, block, or obscure ads, and not to engage in fraudulent activity relating to ads (such as generating invalid clicks or impressions).

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS, OR THAT ANY CONTENT IS ACCURATE OR RELIABLE.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT WILL WE OR OUR OFFICERS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM, OR (B) USD $100.

11. Indemnification

You agree to indemnify, defend, and hold harmless See The World Closer and its affiliates, officers, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or related to your User Content, your use of the Service, or your violation of these Terms or any law or third-party right.

12. Termination

You may stop using the Service at any time. We may suspend or terminate your access at any time, with or without cause or notice. Upon termination, the licenses you granted for previously posted User Content and all provisions that by their nature should survive (including Sections 3, 9, 10, 11, and 13) will survive.

13. Governing Law & Dispute Resolution

These Terms are governed by the laws of the Republic of the Philippines, without regard to its conflict-of-law rules. Any dispute arising out of or relating to these Terms or the Service will be subject to the exclusive jurisdiction of the courts of the Philippines. To the extent permitted by applicable law, you and we agree to resolve disputes on an individual basis and waive any right to participate in a class, collective, or representative action; where the parties so agree, a dispute may instead be submitted to arbitration seated in the Philippines under the Alternative Dispute Resolution Act of 2004 (Republic Act No. 9285).

14. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will update the “Last updated” date and, where appropriate, provide additional notice. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
